DMCA Notice & Takedown
Neon LED Gift respects the intellectual property of others and follows the notice-and-takedown process of the U.S. Digital Millennium Copyright Act (DMCA). If you believe material on neonledgift.com infringes a copyright you own or are authorized to represent, you can ask us to remove it.
Filing a notice
Send a written notice by email to support@neonledgift.com with the subject line “DMCA Notice”. To be valid, the notice must include:
- Your physical or electronic signature.
- A description of the copyrighted work you believe has been infringed.
- The URL or another precise location of the material on our site.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
What happens next
After we receive a complete notice, we review it and, where appropriate, remove or disable access to the material. We may forward the notice to the person who supplied the material, such as a customer whose personalization request is involved.
Counter-notice
If material you provided was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same email address. It must include your signature; identification of the material and where it appeared; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; and your name, address, telephone number and consent to the jurisdiction of the appropriate court. We may restore the material unless the complaining party informs us that it has filed a court action.
Repeat infringement
We may decline future orders or close accounts of people who repeatedly submit infringing material.
False claims
Under the DMCA, anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether your rights are being infringed, consider getting legal advice before filing.
